Terms of Service

Welcome to ThirdSpot. This User Agreement governs your access to and use of the ThirdSpot website, mobile applications, and services. Please read it carefully.
By creating an account or using ThirdSpot ("ThirdSpot," "we," "us," or "our"), you agree to this Agreement and our Community Guidelines, and acknowledge our Privacy Policy. Additional feature terms apply only when shown before you use that feature. If you do not agree, do not create an account or use the Services.
1. Eligibility
You must be at least 18 years old to use ThirdSpot. By using the Services, you represent and warrant that:
- You are legally permitted to enter into this Agreement
- You are not prohibited from using the Services under applicable law
- You will comply with all laws, rules, and regulations
2. The ThirdSpot Service
ThirdSpot is a social networking platform designed to facilitate real-world connections, including social, professional, and community-based interactions.
ThirdSpot:
- Facilitates introductions and event discovery only
- Does not guarantee matches, compatibility, safety, or outcomes
- Does not supervise or control user behavior
- Is not responsible for offline interactions between users
All interactions, whether online or in person, occur at your own risk.
3. Account Registration & Security
You agree to:
- Provide accurate and current information
- Maintain the confidentiality of your login credentials
- Accept responsibility for all activity under your account
ThirdSpot may suspend or terminate accounts that violate this Agreement, create safety or legal risk, or misuse the Services. Where appropriate, we may provide notice or an opportunity to appeal.
4. User Conduct
You agree not to:
- Harass, threaten, exploit, stalk, or harm others
- Impersonate any person or entity
- Post unlawful, abusive, hateful, or misleading content
- Use the Services for commercial solicitation without permission
- Circumvent safety, moderation, or reporting systems
Violations may result in immediate account suspension or termination.
5. Content You Provide
You retain ownership of content you submit to ThirdSpot. By posting content, you grant ThirdSpot a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt for technical formatting, and display that content only as needed to operate, improve, secure, and promote the Services. This license ends when the content is deleted, except for copies retained for legal, safety, backup, or technical reasons for a limited period.
You represent that you have all rights necessary to grant this license.
6. No Background Checks
ThirdSpot does not conduct criminal background checks, identity verification, or screenings of users. You are solely responsible for:
- Evaluating other users
- Taking precautions when interacting or meeting in person
7. In-Person Interactions & Assumption of Risk
You acknowledge that:
- ThirdSpot facilitates introductions only
- Meeting users in person is voluntary
- Real-world interactions involve inherent risks, including physical, emotional, or financial harm
- You voluntarily assume all risks associated with interactions arising from the Services
8. Events, Tickets & Paid Experiences
8.1 Third-Party Role
ThirdSpot may facilitate the listing, promotion, and sale of tickets for events, experiences, or meetups ("Events"). Unless explicitly stated otherwise:
- ThirdSpot provides the marketplace and payment technology for third-party organizers
- Events are organized, hosted, and operated by third-party hosts or venues
- ThirdSpot does not control, manage, or supervise Events
8.2 Ticket Sales
By purchasing a ticket through ThirdSpot, you acknowledge that:
- Ticket availability, pricing, and policies are determined by the Event host
- All sales may be final and non-refundable unless stated otherwise
- The organizer is responsible for the Event, subject to any rights you have under applicable law
- Additional terms imposed by hosts or venues may apply
8.3 Limitation of Responsibility
To the extent permitted by applicable law, ThirdSpot is not responsible for:
- Acts or omissions of Event hosts, venues, vendors, or attendees
- Injuries, losses, damages, or disputes arising from Events
- Alcohol service, security, or venue conditions
Attendance at Events is voluntary and at your own risk, and all liability waivers in this Agreement apply.
9. Fees & Payments
ThirdSpot may offer paid features or ticketing services. The first price displayed for a live-event ticket includes all mandatory ThirdSpot and organizer fees known at that time; government taxes and genuinely optional charges are identified before payment. Payments are processed by Stripe, and Stripe’s terms may apply.
10. Disclaimer of Warranties
The Services are provided "AS IS" and "AS AVAILABLE." To the extent permitted by law, ThirdSpot disclaims implied warranties, including:
- Merchantability or fitness for a particular purpose
- Accuracy, reliability, or uninterrupted availability
- User behavior, conduct, or outcomes
11. Limitation of Liability
To the maximum extent permitted by law, ThirdSpot shall not be liable for:
- Indirect, incidental, consequential, or punitive damages
- Personal injury, emotional distress, or property damage
- Loss of profits, data, or goodwill
ThirdSpot's total liability shall not exceed the greater of $100 or the amount you paid to ThirdSpot in the twelve (12) months preceding the claim. Nothing in this Agreement excludes liability or consumer rights that cannot legally be excluded.
12. Indemnification
If you use ThirdSpot on behalf of a business or host an Event, you agree to indemnify ThirdSpot, its officers, employees, and affiliates from third-party claims arising from:
- Your use of the Services
- Your interactions with users or Event participants
- Your violation of this Agreement or applicable law
13. Termination
You may stop using ThirdSpot and delete your account at any time. ThirdSpot may suspend or terminate an account as described in Section 3. Sections that by their nature should survive termination remain in effect.
14. Governing Law & Disputes
Applicable United States law and the law of the state where Second Life Software is legally established govern this Agreement, without taking away mandatory consumer rights that apply where you live. A claim may be brought in a court with lawful jurisdiction. ThirdSpot does not impose arbitration or a class-action waiver through this version of the Agreement.
15. Changes to This Agreement
ThirdSpot may update this Agreement. We will give reasonable advance notice of material changes and request renewed acceptance where required by law. Changes do not apply retroactively unless the law requires it.
